Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

An employee in this position performs a variety of duties, within an assigned Environmental Protection Region, to ensure compliance with rules, regulations and policies governing environmental and public health protection. Work involves performing compliance assistance activities, tracking and assessing compliance, and reviewing and preparing formal enforcement actions. Work also involves providing training and technical assistance to field personnel, the regulated community and the public on rules, regulations and policies.

Description of Duties:

Performs compliance assistance activities to educate the regulated community about rules, regulations and policies and improve compliance rates.

Tracks and assesses compliance with Oil and Gas rules, regulations and policies per the Program's compliance and enforcement strategy and guidelines for identifying, tracking, and resolving violations in order to protect public health and prevent significant non-compliance status.


Develops and delivers training and provides technical assistance to field personnel, the regulated community and the public on the interpretation and application of rules, regulations and procedures, and on the Program's compliance and enforcement strategy.

Conducts an evaluation of the compliance and enforcement program within an assigned area and prepares a report of recommendations based on the evaluation.

Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.

Provides advice to field personnel and the regulated community on the interpretation and application of rules, regulations and policies governing environmental and public health protection.

Assists with document compilation and creation as it relates to the Oil & Gas Program's IIJA well plugging projects.

Reviews and prepares formal enforcement actions, such as Notices of Violation, Field Orders, Consent Assessments of Civil Penalty, Assessments of Civil Penalty, Administrative Orders, and Consent Orders of Agreements, indicating violations discovered, corrective action required, control measures to be installed, timeframes for their accomplishment, and established penalties.

Testifies as an expert or material witness in enforcement cases before District Magistrates, the Environmental Hearing Board, or the courts. Meets with violators and negotiates settlements of enforcement cases in terms of corrective action and timeframes for their accomplishment.

Schedules and conducts enforcement conferences or administrative hearings, provides background data on the case, explains the specific enforcement document, and answers questions.

Prepares citation forms, files with District Magistrate, and prosecutes cases on behalf of the Commonwealth, presenting data and examining and cross examining witnesses; recommends imposition of fines to District Magistrate.

Researches case files and case history, and prepares documentation for use in the prosecution of cases by field personnel or legal staff. Contacts legal staff and discusses enforcement cases, seeks clarification on rules and regulations from legal staff.

Prepares letters, reports and correspondence.

Performs similar work, as required.

Tracks compliance, penalties and schedules for specific enforcement documents with regard to the Department's databases and generates reports specific to these activities.

Evaluates and assists business and industry in pollution prevention and energy efficiency initiatives relative to program specific issues. Assist with regional OPPEA by attending site visits as assigned. Provides pollution prevention and energy efficiency information during the course of daily relationships with regulated community.

The employee in this position demonstrates the ability to effectively and appropriately make independent decisions and reasonable recommendations within the scope of job duties and responsibilities on a daily basis. The employee in this position will perform necessary work tasks without specific direction, to ensure that work assignments of the employee are completed within establishes deadlines to meet the goals and objectives of the program. Deadlines and goals are set by the supervisor (Environmental Group Manager) and Management team, unless otherwise promulgated by governing policies, procedures, statues, laws, regulations, and/or other guidance documents. The employee is responsible for independently scheduling daily and weekly tasks, unless otherwise directed by supervisor (EGM) or management team. Work is reviewed by the Supervisor (Environmental Group Manager) on a routine basis. Work is reviewed upon completion of the assignment(s)/task or upon request by the Supervisor (EGM) or Program Manager.

Employee demonstrates the ability to understand varying circumstances, cases, and limitations when making independent decisions. Routine problems are resolved through interpretation of applicable guidelines, policies and regulations. Non-routine issues are discussed with upper management and other associates and experts as necessary and upon recommendation of the Supervisor (Environmental Group Manager) and/or Program Manager.

Legal actions and escalated enforcement are created by the employee in this position routed to the Environmental Group Manager, then program manager, and internal counsel as instructed.


Work includes providing advice and guidance to team members oil and gas operators, well drillers, gas storage operators, geologists, engineers, land developers, consultants, citizens, and land owners regarding proper methods of drilling, casing, operating and plugging of wells and the proper interpretation of oil and gas laws, rules, regulations, policies and procedures.

Emergency and off-hour work is assigned as needed.


Work product review is continuous based on standards of quality, quantity, and timeliness set for by performance standards and by the supervisor. Overall performance is summarized through the yearly employee performance review.
