Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

This position’s primary responsibility is the implementation of the Department’s enforcement policies and procedures pertaining to the Clean Streams Law and the Rules and Regulations governing Water Quality Management. Responsibilities include compliance for the Chapter 94 Municipal Wasteload Management program.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

Implements the regional Chapter 94 Wasteload Management program. Activities include, but are not limited, to:
• Catalogs, tracks and reviews annual reports submitted by wastewater collection, conveyance and treatment system permittees who are subject to the program. Provides comments on these reports via written and/or electronic communication to permittees.
• Prioritizes reviews based on the potential presence of an existing or projected hydraulic or organic overload and based on input from the Section Chief and Clean Water Program Manager.
• Prepares review letters identifying the results of the review.
• For systems in existing or projected hydraulic overload, requires a Corrective Action Plan and a Connection Management Plan (CAP/CMP).
• Reviews periodic reports on the progress of corrective actions and connection requests under a CMP. Recommends the release of connections based on the review of information provided by the permittee.
• Maintains all internal data management spreadsheets.
• For facilities under a CAP/CMP, refer SSOs to section chief annually for resolution of civil penalty liability under a CACP.
• Develops compliance strategies to deal with specific cases.
• Coordinates with staff in the Act 537 Planning Section on CAP/CMP submissions and updates.
• Processes enforcement procedures as directed by applicable Department enforcement SOPs, policies and program strategies. Enforcement activities include, but are not limited to:
o Reviews and comments on proposed enforcement policies, strategies and SOPs prepared by Central Office.
o Prepares of notices of violation (NOVs), Administrative Orders, Field Orders, Consent Orders and Agreements, Consent Assessments of Civil Penalty, Consent Assessment and Settlement Agreements, and settlement letters.
o Calculates civil penalties for use in negotiated settlements and/or litigation to resolve Clean Streams Law violations.
o Conducts enforcement conferences.
o Coordinates compliance activities between the program and the Southeast Regional Office of Chief Counsel, including formal consultation with Department attorneys and providing detailed briefing on cases referred for legal review.
o Researches case files and prepares case histories and documentation for use in the prosecution of cases by Clean Water Program or legal staff.
o Provides input, as requested, to Section Chief, Clean Water Program Manager and Regional Director for prioritization of water quality enforcement cases.
• Coordinates enforcement activities with other programs when violations involve more than one program.
• Provides information to Community Relations Coordinators and/or Local Government Liaisons, as appropriate or requested, to describe Department enforcement activities.
• Coordinates with and briefs both regional management and Central Office personnel on enforcement activities involving controversial issues or significant public concern (i.e., actions against municipalities).
• Provides information in response to requests from municipal officials, consultants, stakeholder groups and the public on the Chapter 94 program.
• Prepares items for Weekly Report on significant enforcement actions taken by the Department upon request.
• Updates regional compliance tracking databases, including eFACTS, for Chapter 94 issues as appropriate.
• Follows Standard Operating Procedures (SOPs).
• Provides information to the regional Local Government Liaison in response to inquiries by legislators.
• Organizes and attends meetings with municipal officials, technical consultants and other stakeholders on matters related to the Chapter 94 program.
• Participates in special projects initiatives and workgroups.
• Promotes the Department’s mission.
• Inputs appropriate data in a prescribed format to meet data quality standards set forth by guidance, training, and policy across all of DEP’s electronic data systems; to include ensuring accuracy and completeness of entries, and where available, the use of system specific tools to ensure duplicative entries and data quality issues are minimized.
• Works remotely as required.

Employee reports directly to the Section Chief and work is reviewed for attainment of goals and objectives and for overall quality.
