Position Purpose:

The Bureau of Labor Law Compliance (the “Bureau”) at the PA Department of Labor & Industry monitors and enforces Pennsylvania’s laws that protect the rights of farm workers, including the Seasonal Farm Labor Act. The Bureau executes these responsibilities by assigning a Farm Labor Investigators specifically to enforcement efforts on behalf of some of the most vulnerable workers in the Commonwealth, farm workers. The Farm Labor Investigator is responsible for conducting investigations into the working conditions, wage payments, and overall labor practices of agricultural employers to ensure compliance with federal and state labor laws. The investigator will assess whether agricultural laborers are being treated fairly, paid according to legal standards, and provided with safe working environments. This position also involves educating both employers and workers about their rights and responsibilities under the law.

Description of Duties:

• Under general supervision, the Farm Labor Investigator enforces 13 state labor laws, with a focus on the Seasonal Farm Labor Act, to ensure that the rights of farm workers in Pennsylvania are protected.
• Conduct Investigations: Investigate farm labor practices by visiting agricultural worksites, interviewing growers and employers, farm labor contractors, and farm workers in the field or on the phone, and
reviewing payroll and employment records to determine compliance with labor regulations.
• Conducting inspections of farm labor camps to ensure compliance with state law.
• Identifying violations of the Seasonal Farm Labor Act and other state labor laws during outreach visits.
• Ensure Compliance: Monitor and enforce compliance with state and federal labor laws.
• Report Findings: Prepare detailed investigation reports summarizing findings, violations, and recommended actions. This may include making referrals for penalties or for legal action when necessary.
• Education: Provide guidance to farm workers about their rights, including wage entitlements, safe working conditions, and housing standards. Educate growers, farm labor contractors, organizations,
employees, and public officials on the requirements of laws as they relate to seasonal farm workers.
• Participate in community outreach programs to educate both farm laborers and employers on labor rights and obligations, including health and safety standards.
• Employer Consultation: Advise farm owners and labor contractors on their legal obligations and recommend best practices to improve compliance and protect worker safety.
• Data Management: Maintain timely and accurate records of investigations, cases, and settlements in compliance with departmental standards and regulations.
• Preparing detailed reports of investigations and filing monthly case summaries with the Director of Labor Law Compliance and Deputy Secretary for Safety & Labor Management Relations.
• Collaborate with Stakeholders: Work closely with government agencies, non-profit organizations, and labor advocacy groups to improve working conditions and protect farm workers’ rights.
• Perform Bureau directed outreach to farm workers.
• Receive and screening complaints from farm workers.
• Conduct audits of payroll records, timecards, employment contracts, and other related materials.
• Monitor H-2A job orders for compliance with state labor laws.
• Engage in the foreign labor certification process with the Bureau of Workforce Partnership Operations.
• Assist with the filing of prosecutions when necessary.
• Engage with stakeholder agencies and organizations.
• Discuss difficult matters with supervisor.
• Perform other related duties as required.

The Farm Labor Investigator must make decisions, in collaboration with a supervisor, as to the course of the investigation and when it is appropriate to write letters, have administrative conferences or conduct field visits.

The Farm Labor Investigator works closely with their supervisor to determine what case-related actions must be taken.
