Position Purpose:
Describe the primary purpose of this position and how it contributes to the organization’s objectives. Example: Provides clerical and office support within the Division to ensure its operations are conducted efficiently and effectively. 

Performs supervisory and quasi-judicial work in the adjudication of appeals involving a broad range of Human Services program regulations. Supervises the scheduling, conducting and adjudicating of recipient and non-recipient appeals by Human Services Hearing Officers in a variety of subject matter jurisdictions within the Department of Human Services or other Departments (under an Interagency Agreement). Reviews final work products by Human Services Hearing Officers for conformity to established laws, policies and procedures, as well as for overall program effectiveness.

Description of Duties:
Describe in detail the duties and responsibilities assigned to this position. Descriptions should include the major end result of the task. Example: Types correspondence, reports, and other various documents from handwritten drafts for review and signature of the supervisor.

1. Supervise the work of Human Services Hearing Officers. Participate in the supervision and review of subordinates' performance consistent with operational and workload requirements.

2. Participates in or provides direct assistance to staff in more complex and difficult cases.

3. Assign and reassign appeals to hearing officers to equalize workload and expedite the disposition of cases. Assess regional recipient operations for workload distribution/equalization. Develop contingency plans for staff shortages and increased workload. Monitor the timeliness of the region by creating, reviewing, utilizing the Interim Relief (IR) reports for the region, the Bureau, and program office(s) upon request. Responsible for utilizing BHA’s electronic case database to process and manage their caseload and ensure their subordinates are trained to do the same.
4. Confer with subordinate staff and/or appellants, or counsel on regulations and issues pertinent to appeals.

5.Train newly assigned hearing officers to enable them to develop into independently functioning employees capable of scheduling and conducting a broad range of appeal hearings. Train permanent hearing officers to enable them to grow and develop sharper, stronger skills as hearing officials, with experiences in the major subject matter jurisdictions relevant to the position.

6. Conduct case reviews of subordinates' decisions for quality and consistency as required by Internal Policy. Reviews 10% of all non-case review decisions within one week.

7. Initiate corrective disciplinary action for minor misconduct by employees and recommend major corrective disciplinary actions or dismissals to the Director or Regional Manager.

8. Prepare employee performance evaluation reports and forms.

9. Approve leave and supervise personnel attendance.

10. Direct the compilation and maintenance of required correspondence and documentation.

11. Conducts quasi-judicial administrative hearings by contacting parties, explaining hearing process, ruling on pre-hearing motions, conducting pre-hearing conferences, recording hearings (tape, digital or court stenographer), administering oaths, examining witnesses, determining timeliness of appeals, clarifying issue(s), limiting testimony to relative issues involved, permitting cross-examination, ruling on motions, clarifying cited regulations, receiving exhibits, holding record open for briefs and exhibits if necessary and formally closing hearing, thereby assuring a fair and objective hearing. Schedule and conduct appeal hearings, including those of the most complex and difficult type, as time and workload permit.

12. Completes an Adjudication and Order or Recommendation as a fact finder by objectively considering and evaluating testimony, exhibits, briefs and arguments presented at the hearing. Applies the appropriate regulation(s) accordingly. Completes and processes the hearing record within the regulatory timeframe.

13. Maintains and updates manuals and researches existing policies. Reads, files and utilizes manual policy clarification, bulletins and directives. Inform staff of newly adopted rules, regulations, policies and procedures which affect assigned subject matter jurisdictions.

14. Interfaces with appellants, attorneys, representatives, Departmental agencies and interested parties, when necessary to grant continuances, reschedule hearings, verify withdrawals, and issue subpoenas. Receives and appropriately processes correspondence.

15. Conduct unit meetings at least quarterly.

16. Maintains a system to track the status of case assignments.

17. Attends and participates in required meetings and/or training sessions as scheduled.

18. Performs other related duties including but not limited to project management, site administrative tasks, and special projects as assigned.

19. Provides supervisory and administrative resource support for the regional offices' Administrative Law Judge staff.

20. Operates videoconferencing equipment, a personal computer, tape recorder, telephone, FAX machine, copier, calculator and digital recording device in the performance of their duties. Responsible for utilizing BHA’s electronic case database to process and manage their caseload and ensure their subordinates are trained to do the same.

21. Travel as necessary.

1. Determine if subordinates' decisions are ready to be issued.
2. Prepare and verify for accuracy all monthly reports showing progress and performance of subordinates. Forward to Regional Manager for review.
3. Adjudicate appeals assigned and forward to Regional Manager for final disposition.
4. Train subordinates in current policy, regulations and manual provisions.
5. Monitor leave usage and attendance of subordinates.
6. Work with colleagues as part of statewide and office-wide management team.
7. Determine if disciplinary proceedings are needed.
8. Prepare employee performance evaluations in a timely manner.
9. Maintains discretion and confidentiality in accordance with Bureau and Departmental Policy.
