JOB TITLE: DIRECTOR, LICENSING OFFICE, BANKING AND SECURITIES

JOB CODE: 03260

DEFINITION: This is responsible administrative and managerial work in directing, planning, and implementing the statewide licensing program for non-depository financial institutions regulated by the Department of Banking and Securities.

The employee in this job is responsible for planning and directing the review, processing, analysis, approval, or denial of applications for new licenses and the annual renewal of existing licenses for non-depository financial institutions. These institutions include but are not limited to consumer discount companies, money transmitters, pawnbrokers, installment sellers, motor vehicle sales finance companies, mortgage lenders, correspondents, brokers, servicers, debt management, debt settlement, check cashers, and other non-depository financial companies. Work involves developing and implementing operating procedures and policies for licensing non-depository institutions; managing the administrative and investigative licensing functions; overseeing and directing administrative and enforcement actions initiated in cases of non-compliance; providing input into legislation affecting licensing activities; conferring with legal staff on new or unusual issues related to the licensing program; and meeting with licensees, industry representatives, and other regulatory agencies as necessary. Supervision is exercised over a professional staff. Work is performed independently and is reviewed by the Deputy through conferences, written reports, and an evaluation of overall program effectiveness.

• Directs the licensing activities for non-depository financial institutions.

• Oversees the review and investigation of applicants and current licensees’ financial responsibility (credit), criminal background checks, and regulatory enforcement actions taken by other regulatory agencies.

• Designs and develops processes, forms, operating procedures, and guidelines for administration of the licensing program.

• Develops, implements, and administers program policies, standards, and procedures for licensing non-depository financial institutions.

• Analyzes proposed legislation with the potential to affect the licensing program and makes recommendations to the executive staff.

• Meets with licensees and their legal representatives to discuss licensing regulations and requirements.

• Serves as liaison between the department and other state agencies on issues pertaining to the licensing program.

• Recommends or initiates proceedings for license administration and enforcement actions.

• Reviews and monitors industry trends.

• Conducts special studies and prepares reports for review by the Deputy Secretary and other executive staff.

• Performs the full range of supervisory duties.

• The employee in this job may participate in the performance of subordinates’ work consistent with operational or organizational requirements.

• Performs related work as required.

ENTRY LEVEL KNOWLEDGES, SKILLS, AND ABILITIES:

• Knowledge of accounting principles and best practices.

• Knowledge of procedures, practices, and records employed in the operation of non-depository financial institutions.

• Knowledge of licensing programs for non-depository financial institutions.

• Knowledge of the use and functionality of Microsoft Office Suite software.

• Knowledge of investigative procedures and techniques.

• Ability to interpret various legal documents.

• Ability to analyze, interpret, and apply laws, rules, and regulations.

• Ability to analyze and interpret data and reports.

• Ability to communicate effectively in writing.

• Ability to communicate effectively orally.

• Knowledge of the principles and practices of employee supervision.

• Ability to develop, interpret, and implement policies and procedures for the Licensing Office.

MINIMUM EXPERIENCE AND TRAINING: (NOTE: Based on the Entry Level Knowledges, Skills, and Abilities):

One year as a Financial Institution Enforcement Administrator (commonwealth title) or one year as a Senior Non-Depository Financial Institutions Examiner (commonwealth title);

or

Five years of professional experience in the review and examination or investigation of non-depository financial institution records and operations for conformance to laws, rules, and regulations; and a bachelor’s degree, which includes nine college credits in accounting, finance, economics, or a closely related field;

or

An equivalent combination of experience and training which includes nine college credits in accounting, finance, economics, or a closely related field.
